Board of County Commissioners Meeting
2pm – Public Hearing on Lot Split Request at Cork & Beta
The request for the 5-acre lot split and density change from RS 1/5 to RS 1/2 at Cork and Beta is going before the Board of County Commissioners for their final vote to either approve or deny this request.
We are requesting they Deny this request because:
- It will further degrade our Lake Avalon Rural Settlement, who’s Ordinance states, “The predominant designation shall be RS 1/5 to reflect the existing development pattern”. Currently the predominant designation, is not RS 1/5 based on the number of parcels, as there are 235 parcels of RS 1/1 and RS 1/2 and 198 parcels of RS 1/5.
- By approving this request, the BCC will set a dangerous precedent as it will compel the County to approve all other 5-acre lot split requests in close proximity to a RS 1/1 or RS 1/2 lot. This will start a domino effect and has the potential to turn our Rural Settlement into a Suburban Settlement.
- Our parcels of RS 1/1 and RS 1/2 were GRANDFATHERED at the time we became a Rural Settlement. AFTER we became a Rural Settlement, all the County approved lot splits have been larger lots of 10+/-acres to RS 1/5. Therefore, this request is not consistent with the current development patterns of RS 1/5, based on Orange County’s approvals.
